Terms of Service

1. Service Description

Orbicast is a multi-brand social media publishing platform operated by Function 10 Media LLC. It allows authorized users to connect social media accounts, compose posts, configure approval workflows, and publish content to connected platforms including Meta (Facebook and Instagram). Access is currently limited to invited users only.

2. Acceptable Use

You agree to use Orbicast only for lawful purposes and in ways that do not violate the terms of any connected social media platform. You may not use Orbicast to:

• Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Circumvent or interfere with the security features of the platform
• Use the platform to send spam or unsolicited commercial messages
• Violate Meta's Community Standards, Facebook's Terms of Service, or Instagram's Community Guidelines when publishing through Orbicast to Meta platforms

3. User Responsibilities

You are responsible for all content posted through your account and for maintaining the security of your login credentials. You agree to:

• Provide accurate information when creating your account
• Keep your password secure and notify us immediately of any unauthorized access
• Ensure you have the necessary rights and permissions for all content you post
• Comply with the terms of service of each platform you connect to Orbicast

4. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, violation of any connected platform's policies, or for any other reason at our discretion. You may close your account at any time by contacting support@function10media.com. Upon termination, your data will be retained for 30 days then deleted, unless law requires longer retention.

5. Limitation of Liability

Orbicast is provided "as is" without warranties of any kind, express or implied. Function 10 Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of or inability to use the service. Our total liability to you for any claims arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

6. Meta Platform Compliance

Orbicast integrates with Meta Platforms, Inc. APIs to enable publishing to Facebook and Instagram. By connecting a Meta account, you agree to comply with Meta's Platform Terms (developers.facebook.com/terms), Meta's Community Standards, and all applicable Meta developer policies. Orbicast operates as an authorized Meta app and adheres to Meta's Platform Policy in the collection, use, and storage of all data received through Meta APIs.

Orbicast does not guarantee the delivery of posts to Meta platforms. Meta may reject, delay, or remove posts at the API level for reasons including but not limited to policy violations, rate limiting, token expiration, or platform outages. Function 10 Media LLC is not liable for any post that fails to publish or is removed by Meta after publication.

7. TikTok Platform Compliance

Orbicast integrates with the TikTok Content Posting API to enable publishing video content to TikTok creator accounts. By connecting a TikTok account to Orbicast, you agree to comply with TikTok's Terms of Service (tiktok.com/legal/terms-of-service), TikTok's Developer Terms of Service (developers.tiktok.com/doc/developer-terms-of-service), and all applicable TikTok platform and community policies.

By connecting your TikTok account and scheduling or approving a post through Orbicast, you explicitly authorize Orbicast to publish that content to TikTok on your behalf. You may revoke this authorization at any time by disconnecting your TikTok account from Orbicast.

You may not use Orbicast to post content to TikTok that violates TikTok's Community Guidelines, including but not limited to content that promotes violence, hate speech, misinformation, or infringes on the intellectual property rights of others.

Orbicast does not guarantee the delivery of content to TikTok. TikTok may reject, delay, or remove posts at the API level for reasons including policy violations, rate limiting, token expiration, or platform outages. Function 10 Media LLC is not liable for any post that fails to publish or is removed by TikTok after publication.

8. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Texas.
